Public offer agreement
English translation for convenience. The Ukrainian version is the governing text — read it here.
Version of 11 October 2026. Applies to orders placed after it was published on the site.
1. Parties and subject
1.1. This agreement is a public offer under Articles 633, 641 and 642 of the Civil Code of Ukraine. It is made between individual entrepreneur Dmytro Ivanovych Hrymalyuk ("Seller", "DimaRS", "we") and any person with full legal capacity who places an order on https://dimars.com.ua (the "Site") (the "Buyer").
1.2. The Seller transfers to the Buyer ownership of goods — stocks, rear bags, scope rings, accessories and other DimaRS products (the "Goods") — and the Buyer pays for and accepts them on the terms of this agreement.
1.3. The terms are the same for every buyer. The Buyer must be at least 18 years old.
1.4. This agreement is concluded in electronic form under the Law of Ukraine "On Electronic Commerce" and has the same legal force as an agreement signed on paper.
2. How the agreement is concluded (acceptance)
2.1. The Buyer accepts this offer by placing an order on the Site and ticking the box confirming agreement with these terms. The agreement is concluded from that moment.
2.2. After ordering, the Buyer receives an email confirmation with the order number, the Goods, the chosen options, the price and the shipping cost. This confirmation is the electronic document confirming the agreement.
2.3. Where an order is agreed by correspondence (email, messengers), the Buyer accepts by paying the invoice the Seller issues.
3. Goods made to order
3.1. Most Goods are handmade for a specific order to the parameters the Buyer chooses: model, colour, material, height, fill, options, fit to a particular rifle, action or stock, and so on ("Made-to-order Goods"). Goods marked "Ready to ship" on the Site are already made and ship without production ("Ready-to-ship Goods").
3.2. The Buyer is responsible for choosing the right parameters, including fit with their rifle, action, rail, scope and other equipment. If in doubt, the Buyer can write to the Seller before paying and we will help choose.
3.3. Wood, laminate and fabric have natural differences in grain, texture and shade, and colours on screen can differ from the real item. Such differences are not defects.
3.4. Approximate lead times are shown on the Site (at the time of this version: stocks 4–6 weeks, rear bags 8–12 weeks) and run from the day payment is received. Shipping time is not included. The Seller tells the Buyer about any delay in production.
3.5. If the Seller cannot make Made-to-order Goods at all, or the delay exceeds the stated lead time by more than 30 days, the Buyer may cancel the order and receive a full refund of the amount paid.
4. Price and payment
4.1. Prices on the Site are in US dollars (USD) per item, including the chosen options. Shipping is shown separately at checkout. The Seller may change prices on the Site; the price of an order already placed and paid does not change.
4.2. The Buyer pays 100% of the order (Goods and shipping) by: bank card, Apple Pay or Google Pay through the WayForPay payment service; PayPal; bank transfer against the Seller's invoice; or another method agreed with the Seller.
4.3. Production of Made-to-order Goods starts once full payment is received.
4.4. Currency conversion and fees charged by the Buyer's bank are paid by the Buyer. Card details are processed by the payment service; the Seller never receives or stores them.
4.5. If a price on the Site contains an obvious technical error, the Seller tells the Buyer before shipping; the Buyer may accept the correct price or cancel with a full refund.
5. Shipping
5.1. Goods are delivered by a carrier (postal or courier service) to the address the Buyer gives. Rates are listed on the "Shipping & returns" page. For countries not listed and for large orders, the Seller agrees the shipping cost with the Buyer before payment.
5.2. The Buyer is responsible for a correct address and contact details. If a parcel is returned because of a wrong address or because the Buyer did not collect it, the Buyer pays for re-sending.
5.3. Import duties, taxes (including VAT of the destination country), customs clearance and brokerage fees in the Buyer's country are not included in the price and are paid by the Buyer. The Seller declares the real value of the Goods on customs documents and is not responsible for the time customs takes.
5.4. The Buyer is responsible for checking that the Goods may be imported and used in their country. In line with Ukrainian law, the Seller does not sell or ship to the aggressor state or to sanctioned persons.
5.5. The Seller's obligation to deliver is fulfilled when the Goods are handed to the carrier for delivery to the Buyer (Article 664 of the Civil Code of Ukraine). Ownership passes to the Buyer when the Buyer receives the Goods.
5.6. The Buyer should inspect the parcel on receipt. If the packaging is damaged, the Buyer records it with the carrier (report, photos) and tells the Seller within 3 days. The Seller helps the Buyer claim from the carrier and works with the Buyer on repair or replacement.
6. Cancellation and returns
6.1. Made-to-order Goods. These are made to the Buyer's individual specification. Under consumer protection law, the right to withdraw from the agreement and to exchange or return goods of proper quality does not apply to such goods. Once paid, a made-to-order order cannot be cancelled, and Goods of proper quality cannot be exchanged or returned, except as set out in clause 3.5.
6.2. Ready-to-ship Goods. Ready-to-ship Goods of proper quality cannot be exchanged or returned, except where the law that applies to this agreement expressly gives the Buyer that right (in particular a consumer's right to withdraw from a distance contract within 14 days of receiving the Goods). In that case: the Buyer notifies the Seller in writing within the legal period; the Goods come back unused, not fitted or mounted, and complete; the Buyer pays return shipping; and the Seller refunds the price of the Goods within 14 days of receiving them, by the same method used to pay.
6.3. Defective Goods. If Goods have a manufacturing defect, the Buyer has all rights under consumer protection law, plus the warranty in section 7.
7. Lifetime workmanship warranty
7.1. The Seller gives a lifetime warranty on workmanship: for the whole service life of the Goods we fix, free of charge, defects caused by us — faults in seams, glued joints, machining, hardware and construction.
7.2. The warranty does not cover: normal wear (fabric wear, fill settling, scratches to the finish); damage from drops, impacts, misuse, or improper storage or transport; fire, chemicals, prolonged moisture or high temperatures; Goods altered or repaired by anyone else (including inletting, bedding, fitting, drilling or painting); or the differences described in clause 3.3.
7.3. To make a claim, the Buyer emails the Seller the order number with a description and photos of the defect. The Seller will, at its choice, repair the Goods, replace them, or — if neither is possible — refund the price paid for them. If the Goods need to be sent to the Seller, the Buyer pays shipping to the Seller and the Seller pays shipping of the repaired or new Goods back.
7.4. The warranty applies to the original buyer with an order number. It adds to, and does not limit, the consumer's statutory rights.
8. Liability
8.1. Each party is liable for failing to perform this agreement as provided by Ukrainian law.
8.2. DimaRS Goods are sporting equipment. The Seller is not responsible for shooting results, for harm caused by incorrect fitting or use of the Goods, or for the Buyer's compliance with firearms safety rules and laws. We recommend having a stock or other parts fitted to a rifle by a qualified gunsmith.
8.3. To the extent the law allows, the Seller's liability under this agreement is limited to the amount paid for the Goods concerned. This limit does not apply where the law prohibits limiting liability.
9. Force majeure
9.1. Neither party is liable for failing to perform because of circumstances beyond its control: war and martial law, shelling, power outages, decisions of authorities, natural disasters, fires, epidemics, or disruption at carriers and customs. The Seller tells the Buyer about such circumstances and the new approximate timeline. The Buyer's right under clause 3.5 remains.
10. Personal data
10.1. The Seller processes the Buyer's personal data (name, email, phone, delivery address, order details) to perform this agreement — to make and ship the Goods and to contact the Buyer about the order — under the Law of Ukraine "On Personal Data Protection" and our Privacy policy.
10.2. The Seller sends marketing emails only with the Buyer's separate consent, which can be withdrawn at any time.
11. Complaints and disputes
11.1. Complaints are sent to the Seller's email. The Seller reviews and answers within 14 calendar days of receipt.
11.2. Disputes are settled by negotiation and, failing that, in court under Ukrainian law.
11.3. This agreement is governed by the law of Ukraine. If the Buyer is a consumer living in another country, this does not take away the protection given by the mandatory laws of that country.
12. Other terms
12.1. The Seller may change this agreement by publishing a new version on the Site. An order is governed by the version in force when it was placed.
12.2. The agreement is written in Ukrainian; this English translation is provided for convenience. If they differ, the Ukrainian version prevails.
12.3. The agreement remains in force until both parties have fully performed it, and the warranty obligations for the period set out in section 7.
